CRA Engages on New FDA Proposal and USTR Tariff Review

Cigar Rights of America is actively responding to two significant federal developments involving FDA regulation and U.S. trade policy.

FDA Proposes New Registration and Product-Listing Requirements

The U.S. Food and Drug Administration has proposed a rule that would require tobacco manufacturers to register their establishments and submit product listings for tobacco products sold in the United States. The proposal is intended to provide FDA with greater visibility into the domestic market but could also create new compliance obligations for manufacturers and foreign production facilities.

Importantly, premium cigars are not currently subject to FDA regulation as a result of CRA-led litigation. CRA will submit comments urging FDA to ensure that the final rule expressly recognizes the current premium cigar exemption and does not create uncertainty for premium cigar manufacturers, importers, retailers, or foreign production partners.

CRA will also evaluate opportunities to reduce potential compliance burdens on manufacturers should premium cigars ever again become subject to FDA regulation.

CRA Responds to Potential Section 301 Tariffs

CRA is also closely engaged in the Office of the U.S. Trade Representative’s Section 301 investigation involving allegations of forced labor in several countries, including the Dominican Republic, Honduras, and Nicaragua.

As part of that review, USTR is considering potential tariffs on imported goods from those countries. CRA is working with USTR, the U.S. Department of State, and Members of Congress to make clear that broad tariffs on premium cigars would harm American retailers, small businesses, consumers, and the families whose livelihoods depend on the premium cigar industry.

Premium cigar producers remain committed to humane labor practices and transparent, traceable workplaces. These values are fundamentally incompatible with exploitation and should be recognized as USTR considers any future trade action.

These developments demonstrate the continued importance of CRA’s advocacy. Whether the challenge comes through federal regulation, international trade policy, or state and local legislation, CRA remains committed to ensuring that premium cigars are recognized and protected as a distinct product category.
